Storm Water Compliance

A Storm Water Pollution Prevention Plan (SWPPP) is required for all projects disturbing more than one acre. For all such projects, a Notice of Intent (NOI) must be filed with the State Water Resources Control Board. The NOI contains a description of the proposed work as well as a certification by the property owner that their project will conform to all of the requirements of the NPDES General Permit, primarily the preparation and implementation of the SWPPP. The Notice of Termination (NOT), is filed upon project completion and ends the site’s coverage for discharges under the General Permit. A SWPPP is a living document that must be modified as the construction progresses and site BMPs (Best Management Practices) evolve through the duration of the project.

The latest evolution of the State Permit requires each project to calculate a "Risk Level" based on the risk of the project to generate sediment and the potential risk to receiving waters. Determining whether your project will be categorized as a Risk Level 1, 2, or 3 is now a key component to a project's feasibility. Project costs for processing, implementation and maintenance are directly tied to the "Risk Level" of the project. The likelihood of violations and fines also increases dramitically with each Risk Level.

Wunderlin Engineering can perform a Risk Level Analysis for your project - before you buy the property. It is important for all developers of property to understand how the storm water regulations are going to affect your project costs and liabilities.
